The processing of personal data requires a legal basis, which we would like to present to you below.

Insofar as we obtain the consent of the data subject for processing operations involving personal data, Article 6 (1) (a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data.

When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures.

Insofar as the processing of personal data is necessary for the fulfillment of a legal obligation to which our company is subject, Art. 6 (1) lit. c GDPR serves as the legal basis.

In the event that vital interests of the data subject or another natural person make it necessary to process personal data, Art. 6 (1) lit. d GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 (1) lit. f GDPR serves as the legal basis for the processing.

The legitimate interest of our company with regard to the websites lies in the performance of our business activities as well as in the analysis, optimization and maintenance of the security of our online offering.

IV. deletion and storage period of your personal data

Your personal data will be deleted or blocked as soon as the purpose of storage no longer applies.

In addition, storage may take place if this has been provided for by the European or national legislator in Union regulations, laws or other regulations to which the responsible party is subject, e.g. in the case of statutory retention periods. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion of a contract, fulfillment of a contract or further processing that is justified by law.

V. Contractual processing

In the context of an order or contract initiation, we collect personal data of the contact persons and parties involved as well as other information that is necessary for the order. We need this data so that we can identify you as a customer, process the order, respond to your inquiry, submit an offer, contact you or for billing purposes.

The data processing takes place on the basis of our business initiation and is necessary according to Art. 6 para. 1 p. 1 lit. b GDPR for the stated purposes for the appropriate processing of your request or for the mutual fulfillment and obligation arising from the contractual relationship.

Data entered and/or collected by you will only be passed on for the purpose of order fulfillment, for example to group companies, shipping companies or payment service providers, or if we are legally obliged and/or entitled to do so.

You have a right to information about the personal data stored by us about you. According to the legal provisions, you also have the right to correct incorrect data, restriction of processing, data portability and deletion of your personal data. If the legal requirements are met, we will subsequently no longer process your personal data.

In the case of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling, insofar as it is associated with such direct marketing.
Your objection means that the personal data will no longer be processed for these purposes.

B. Data collection and use by our website hytect.de

I. log files and hosting

You can visit our website without providing any personal information. Each time you visit our website, our system automatically collects data and information from the computer system of the calling computer. The following data may be collected:

  • Referrer URL (the previously visited page
  • Host name of the accessing computer (IP address)
  • Date and time of the server request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Data volume transferred
  • Access status / HTTP status code.

The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

Our legitimate interest also lies in these purposes.

As a rule, we cannot assign this data to specific persons. A combination of this data with other data sources is not made. The data is also deleted within 90 days after a statistical evaluation. Data whose further retention is required for evidentiary purposes is excluded from deletion until final clarification of the respective incident.

We make use of hosting services. These serve to provide infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services to maintain the operation of this online offer.

In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta data and communication data of customers, interested parties and visitors of this online offer on the basis of our legitimate interests in an efficient and secure provision of this online offer.

IV. disclosure of data to website services

In part, we use external service providers within the scope of your consent with regard to analysis, optimization and economic operation of the online offer. This always requires that the third-party providers of this content are aware of the IP address of the user, since without the IP address they could not send the content to their browser. The IP address is thus necessary for the display of this content. Third-party providers may also use so-called pixel tags (invisible graphics, also "web beacons") for statistical or marketing purposes. a. Google Analytics

This website uses Google Analytics as a web analysis service. Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. We would like to point out that this website uses Google Analytics with the extension "_anonymizeIp()" and therefore IP addresses are shortened by Google in Member States within the European Union or in other contracting states of the Agreement on the European Economic Area before transmission in order to exclude a direct reference to persons. b. Google Maps

We use content from Google Maps for our website. However, this map content is only loaded if you confirm this at the respective location on our website. c. YouTube

We use the provider YouTube, a service of Google, to embed videos.

These videos are stored on www.youtube.com and can be played directly from our site. YouTube uses cookies for data collection and statistical data analysis. YouTube uses cookies to, among other things, collect reliable video statistics, prevent fraud, and improve the user experience. The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by YouTube on servers in the United States. Your IP address cannot be assigned unless you have logged in to YouTube or another Google service before accessing the page or are permanently logged in. If you do not wish this, you must log out of your YouTube account and your other Google accounts.

Through the YouTube cookies, we receive statistical values on the retrieval of individual videos embedded in the website without a reference to the respective user.

d. Google Fonts

We integrate the fonts ("Google Fonts") of the provider Google when using Google Maps, provided that you have given your consent for this (see "Google Maps"). The integration of these web fonts takes place via a server call, usually a Google server in the USA. This transmits to the server which of our websites you have visited. The IP address of the browser of the end device of the visitor to these web pages is also stored by Google. e. Google Tag Manager

We use the Google Tag Manager. This enables us to manage website tags via an interface and thus integrate e.g. Google marketing services into our online offer. The Tag Manager itself does not process any personal user data. For the respective Google services, please refer to the respective notes and the usage guidelines under https://www.google.com/intl/de/tagmanager/use-policy.html.

f. DoubleClick

We use the online marketing solution Google "DoubleClick" to integrate ads in the Google advertising network. DoubleClick is characterised by the fact that ads are displayed in real time based on the presumed interests of users. This means that ads within our online offers are displayed in a more targeted manner, and users are only shown ads that potentially address the user’s interests and in which they have already expressed an interest on other websites in the network, for example (“Remarketing”). For these purposes, when you visit our website and other websites on which the Google advertising network is active, a code is executed directly by Google and so-called (re)marketing tags are incorporated into the website. Hereby an individual cookie is set on the user’s device (instead of cookies, comparable technologies can also be used). The cookie records which websites the user has visited, what content the user is interested in and which offers the user has clicked on, as well as technical information on the browser and operating system, referring websites, visiting time and other information on the use of the online offer.

The IP address of users is also recorded, although this is shortened within member states of the European Union or in other states which are party to the Agreement on the European Economic Area and only in exceptional cases is it transmitted in full to a Google server in the USA and shortened there. Google may also combine the above-mentioned information with information from other sources.

User data is processed pseudonymously within the Google advertising network. Thus, from Google’s point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who that cookie holder is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information collected by Google marketing services about users is transmitted to Google and stored on Google’s servers in the USA.

2. Facebook (Meta)

We use services of the social network facebook.com, which is operated by Meta Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook" or "Meta"), as part of our legitimate interests in the analysis, optimization and economic operation of our online offering.

Facebook Social Plugins

Our website uses social plug-ins ("plug-ins") from Facebook. The plug-ins are marked with a Facebook logo (white "f" on a blue tile, the terms "Like", "Like" or a "thumbs up" sign) or the addition "Facebook Social Plug-In".

We use the so-called 2-click solution. When you visit our site, no personal data is passed on to Facebook. Only when you activate the plug-in, your browser establishes a direct connection with the Facebook servers. The content of the plug-in is transmitted by Facebook directly to your browser, which then integrates it into the website. This transmits personal information, such as your IP address, URL, date and time, as well as other browser-related information to Facebook and stores it in the U.S., whereby according to Facebook in Germany only an anonymized IP is collected.

If you are logged in to Facebook, Facebook can assign the visit to your Facebook account. If you interact with the plug-ins, for example by clicking the "Like" button or posting a comment, the corresponding information is transmitted directly from your browser to Facebook, stored there and, depending on your Facebook settings, shared with your Facebook contacts. If you do not wish this to happen, please log out of your Facebook account (before pressing the opt-in button).

Facebook stores your data as usage profiles and uses them for the purposes of advertising, market research and/or needs-based design of its website and other websites. In doing so, Facebook uses cookies and similar technologies to display advertisements to you on Facebook services as well as outside of them, regardless of whether you have an account with Facebook and are logged in. 3. Hotjar

We use Hotjar, a service provided by Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, to better understand the needs of our users and optimize the experience on this website. Using Hotjar's technology, we get a better understanding of our users' experience (e.g. how much time users spend on which pages, which links they click on, preferences, etc.) and this helps us to tailor our offering based on our users' feedback. Hotjar works with cookies and other technologies to collect information about our users' behavior and about their devices, in particular IP address of the device (collected and stored only in anonymized form), screen size, device type (Unique Device Identifiers), information about the browser used, location (country only) to indicate the preferred language of the website. 4. HubSpot

On this website, we use HubSpot for our online marketing activities. HubSpot is a software company from the USA with a branch in Ireland. This is an integrated software solution that we use to cover various aspects of our online marketing. These include: Email marketing (newsletters as well as automated mailings, e.g. to provide downloads), social media publishing & reporting, reporting (e.g. traffic sources, hits, etc. ...), contact management (e.g. user segmentation & CRM), landing pages and contact forms.

5. Friendly Captcha

To protect against misuse due to our legitimate interest, we use the identification service "Friendly Captcha" on our website. This service is provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany.

The query with Friendly Captcha is used to distinguish whether the input in the website form is done by a human or abusively by automated machine processing.

You can avoid the corresponding data collection by not using the function. We draw your attention to the fact that then no requests can be sent.

For this purpose, we have integrated a program code from Friendly Captcha into our website, for example for contact forms, so that the end device of the visitor can establish a connection to the European servers of Friendly Captcha in order to verify the human input by Friendly Captcha. Depending on the result, we can apply security rules to requests via our website and thus, for example, process them further or reject them. The data is used solely to protect against spam and bots as described above. Friendly Captcha does not set or read cookies on the visitor's terminal device. IP addresses are only stored in hashed, i.e. one-way encrypted form and do not allow us and Friendly Captcha to draw any conclusions about an individual person.

6. Vimeo

On our website, plug-ins of the video portal Vimeo of Vimeo, LLC, 555 West 18th Street, New York 10011, USA are integrated with your consent. EU standard contractual clauses have been agreed with Vimeo, so that possible measures have been taken to ensure compliance with European data protection law.
If you have given your consent, a direct connection between your browser and a Vimeo server in the USA is established each time you call up a page that offers one or more Vimeo video clips. In the process, information about your visit and your IP address are stored there. Through interactions with the Vimeo plug-ins (e.g. clicking the start button), this information is also transmitted to Vimeo and stored there.
If you have a Vimeo user account and do not want Vimeo to collect data about you via this website and link it to your membership data stored with Vimeo, you must log out of Vimeo before visiting this website.

7. Zapier

For the integration of various databases and tools, we use Zapier, a service of Zapier Inc, 548 Market St #62411, San Francisco, California 94104, USA. This may involve the transmission of customer data with the exception of payment data.
EU standard contractual clauses have been agreed with Zapier Inc. so that possible measures have been taken to ensure compliance with European data protection law.
Zapier assists in the transfer of website form data to HubSpot (see our information on the HubSpot tool and under B. III).

C. Data collection and use in social media

You can find us on various social media platforms such as Facebook (see the following list). We would like to use these presences to communicate with our customers, interested parties and users who are active there and to inform them about our services and our company in this way.

The processing of the personal data of the users active there is based on our legitimate interests in communicating and providing information to and with the users. If users have given their consent to data processing on the respective social platform, the processing is carried out on the basis of this consent.

If you visit one of our social media sites, we are jointly responsible with the operator of the social platform for the data processing operations triggered during this visit. In principle, you can assert your rights to information, correction, deletion, restriction of processing, data portability and complaint (see point "Your data subject rights") both against us and against the operator of the respective social platform.

We would like to point out that despite the joint responsibility, we do not have full influence on the data processing operations of the social platform and, if necessary, forward the rights request to the respective operator for better processing of the data subject rights. Our options are basically based on the corporate policy of the respective provider.

You can find our storage details above. We have no influence on the storage period of your data, which is stored by the operators of the social platform for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

Depending on the following named social platform, the data processing of users may also occur outside the area of the European Union. EU standard contractual clauses have been agreed with the US companies, so that the measures possible for us to ensure European data protection law have been taken.

As a rule, user data is processed by the platforms for market research and advertising purposes. For example, usage profiles can be created from the usage behavior and resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the platforms that presumably correspond to the interests of the users. For this purpose, cookies are usually stored on the users' computers, in which the usage behavior and interests of the users are stored. Data can also be stored in the usage profiles regardless of the devices used by the users. This occurs in particular if the users are members of the respective platforms and are logged in to them.
